Patent registration grants the patent holder the right to the invention. It grants the patentee rights to supervise, manufacture, practise, trade, or import the patented product or procedure. After a product has been patent-registered, no one is entitled to utilise the invention without first receiving permission from the patentee.
Eligible to Apply for Patent Registration
According to Section 6 of the Patents Act, 1970, an application for a patent may be made by:
• a person who claims to be the true and first inventor of the invention
• another person acting as assignee of the person as above
• a person who is a legal representative of a deceased person who could have filed the application immediately preceding his death
